US: 9th Circ. Affirms Samsung antitrust win

The US Court of Appeals for the Ninth Circuit has rejected a bid by alleged patent troll Cascades Computer Innovation to revive an antitrust lawsuit claiming that Samsung, patent aggregator RPX and others used their monopsony power over Cascades’ patent rights.

In an opinion, a unanimous three-judge panel agreed with the lower court’s finding that Cascades Computer Innovation had not been injured by Samsung Electronics and therefore couldn’t sue the tech giant over US Patent Number 7,065,750.

In its complaint, Cascades alleged that the defendants participated in a conspiracy to monopolize the market to license Cascades’ patents, in violation of Sections 1 and 2 of the Sherman Act and California unfair competition laws.
