UK: CMA publishes guidance on its State aid role in case of a no-deal Brexit

The UK government laid a State aid Statutory Instrument (SI) before Parliament on January 21, 2019, to ensure a domestic state aid regime would be in place by 29 March 29, 2019 in the event the UK leaves the EU without a deal.

This SI transposes the EU State aid regime into domestic UK law and, in the event of no deal, gives the Competition & Market Authority (CMA) the function of being the UK State aid enforcement authority, in place of the European Commission, from the date on which the UK leaves the EU. The SI does not materially alter the substance of the EU State aid framework.

The SI requires the CMA to adopt the existing EU guidelines as statements of policy and publish them by day one of EU Exit. In line with the objectives of the EU Withdrawal Act, only minimal changes will be made to existing guidelines to ensure they are operable on exit day.

The CMA expects to publish its statements of policy before the end of March 2019.
