Swisscom AG will lodge an appeal with the Swiss Federal Supreme Court after the Federal Administrative Court concluded that the company behaved improperly in the 2008 tender process to set up a broadband network at Swiss Post sites.
Swisscom–which operates landline and internet-services provider Fastweb–stated on Wednesday, July 14, that it acted in accordance with the law during the tender process launched by Swiss Post, which requested bids from Swisscom and telecommunications company Sunrise.
Sunrise filed a complaint against Swisscom claiming it had violated the Federal Cartel Act after Swisscom’s bid was accepted in January 2009.
The Swiss Competition Commission concluded in 2015 that Swisscom had abused its market position, a decision corroborated by the Federal Administrative Court which found Swisscom’s conduct was detrimental to Sunrise and Swiss Post.
“Swisscom remains of the opinion that its behavior in this tendering process was entirely in accordance with the law. Swisscom’s intermediate inputs do permit competitive bids from other telecom providers if prepared in a prudent way,” Swisscom stated.
