Philippines: PCC considers expanding immunity rules

The Philippine Competition Commission (PCC) has announced that it is looking at the possibility of reworking its immunity policy for cartel members.

Currently, the PCC only offers immunity to one member of a cartel, but is considering increasing the number to two to broaden the field of those providing evidence against anti-competitive activity.

The immunity would include “immunity from suit includes immunity from administrative fines and criminal liability,” according to draft rules posted on the antitrust body’s website.

PCC Commissioner Johannes Benjamin Bernabe said the agency’s decision to offer immunity to two parties would represent a liberal interpretation of the Philippine Competition Act of 2014, which allows only one such offer, to increase the agency’s leverage in prosecuting violators.
