A federal jury on Monday, March 26 returned a unanimous verdict against a San Antonio allergy testing company that had sought more than US$200 million in damages against parties that it alleged had conspired against it.
San Antonio-based United Allergy Services had sued Allergy and Asthma Network/Mothers of Asthmatics Inc. and its CEO Tonya Winders in 2015 alleging they had participated in a conspiracy to interfere with its business practices.
An eight-person jury sided with the Network and Winders following a three-week trial before Senior US District Judge Royce Lamberth.
“Really what this case was was an effort to shut Ms. Winders up,” said David Prichard, a San Antonio lawyer who was part of her legal team. “This was a David-versus-Goliath case. This was a $100 million company that tried to intimidate her and silence her advocacy on behalf of allergy and asthma patients.” Winders lives in Tennessee.
