Spain: CNMC challenges local restrictions on Gaming halls

Spain’s CNMC has presented a legal challenge to a number of statutes in Valencia’s Community Rules, which restrict the opening of new gaming halls within an 800m radius of existing ones.

The agency believes that the regulations violate the EU’s principle of necessity, enshrined in Spain’s Market Unity Guarantee Law, without excluding the possibility of further violations not yet identified.

The CNMC has the power to issue legal challenges to local legislation whenever it considers that this is necessary to confront any actions by Public Officials which go against the free movement of goods and free competition.
